What are the duties of property owners to prevent accidents?

When we are spending time in public properties such as shopping malls, museums and restaurants, we often take it for granted that we are safe from injury. However, it is all too common for accidents to occur that negatively effect the lives of unsuspecting people. What's worse is that these accidents were often simple to prevent. In cases such as these, property owners had a duty to prevent these accidents.

This blog will answer some frequently asked questions about the duties that property owners have to stop preventable accidents from occurring.

Do property owners have a duty to keep their property safe from ice and snow?

Property owners are not usually held responsible for removing snow and ice that builds up outside of their property. But if there are conditions on their property that prevent the natural decomposition of the buildup, the property may be accountable for any accidents or incidents caused.

If someone informed an employee of a defect, does it help my case?

The short answer is yes. This is because it proves that those responsible for the property knew about the issue and had the opportunity to fix it before the accident happened.

Who is liable for a slip-and-fall accident on a property?

There are often many aspects to every case and many opportunities to hold a person liable. The property owner may be renting to a tenant for instance, and in this case it is likely that the tenant would be liable for someone injured on the property.
