Proving fault: Police reports and your car accident

When you are involved in a car accident, the most important first step is to figure out who the person at fault is. One person, at minimum, is likely to be charged with fault for their driving, impairment or negligence. This may have seemed obvious at the time, but it is important to collect all appropriate evidence and present everything in the proper way.

Proving fault through police reports

If the police came to the scene of the accident, they will have had to create a report or summary of what seemed to have happened at the scene. Police officers generally come to the scene of an accident that involved an injury, but they can also come to the scene of noninjury accidents as well.

It is your right to request a copy of the report when it has been filed, and you may be able to use this to your advantage if the report suggests that another driver was at fault.

Can I amend a police report?

Police reports occasionally can have mistakes, and if this happens in your situation, it is possible for it to be fixed. The mistake may be confined to an incorrect vehicle registration or insurance information, but it could be a much more vital piece of factual information. Getting this fixed on the police report could mean the difference between a successful and unsuccessful claim.

It can be difficult to amend a disputed fact such as fault determination, and it is important to contact the involved departments to learn more.
