How your landlord can do upkeep without invading

Landlords and tenants are often at odds over access to the space. If the landlord is never around, the tenant may complain that he or she doesn't do maintenance and upkeep on the property and that it's now unsafe.

If the landlord is around all the time and enters without the tenant's permission, though, the tenant might then complain that his or her privacy is being violated. Landlords may counter by saying there's no way they can do inspections without access to a property that they own.

There are ways to find balance. For instance, landlords do need to do maintenance and make sure that the property is safe, but they should generally not:

-- Stop by too often, making it a hassle.

-- Show up without giving the tenant any notice. If possible, notice should even be in writing.

-- Fail to be precise about when they'll arrive. They need to tell tenants dates and times and then stick to them so the tenant feels as if he or she is free to do as desired at all other times.

-- Enter the space, even though they own it, without getting permission first, especially if there's not a clear emergency, such as a fire.

-- Tell others, like maintenance workers or contractors, that they can go into the space unaccompanied.

Landlords and tenants can find some middle ground and make sure that the space is safe without annoying or harassing the tenant. That being said, if the landlord decides it's just easier to neglect the property and it becomes unsafe, tenants who are injured may need to know what rights they have to financial compensation.
