Negligence and medical records

There are many reasons that medical records are incredibly important. They allow doctors to properly analyze patients and share data, they allow for a scientific process when trying to determine what ailments a person may be dealing with, and they help to show a person's medical history so that more informed future decisions can be made -- just to name a few.

However, one thing to remember is that they also may be very helpful in negligence cases.

If you allege that your doctor was guilty of negligence, the entire case may swing on those medical records. They can prove or disprove your claim.

For instance, perhaps the wrong type of surgery was carried out. You endured pain and suffering, you have scars and lasting disfigurements, you paid for surgery that wasn't needed, and the actual procedure you did need to have carried out never happened.

At least, that's what you believe. The court may want to check those official medical records to find out exactly what procedure was ordered and why. If the records back up your claim, it's fairly easy to show that the doctors and medical professionals did not do what they should have done. On the other hand, if the records indicate that the medical staff was in the right, it could just be a case of miscommunication, where you didn't know what procedure was going to be carried out.

In short, medical records are invaluable in proving your case. If you think that your doctor was negligent, as you look into your legal options, be sure you get the documentation to back up your claims.
