I suffered a premises liability-related injury: Who should pay?

When you enter someone's property in Florida, you can reasonably expect not to get injured. This essentially means that the owner of the property is responsible for keeping the environment safe. Unfortunately, this does not always happen, and you may end up getting injured on the other party's property, which is grounds for a premises liability claim.

An incident that might lead to a premises liability claim could be a slip-and-fall accident at a store or suffering injuries on a ride at an amusement park. Injuries could also occur in a hotel lobby, somewhere else on hotel property or in a company's parking lot. In addition, a premises liability-related injury may occur at a condominium, apartment or restaurant, to name a few.

Condition of the property

If you are injured on a property and take the matter to court, the court will look at several factors to determine if the property owner has met the standard of reasonable care exercised for a visitor's safety. These factors include the circumstances under which you entered the property where your injury occurred as well as how the property is used.

In addition, the court will examine whether your accident/injury was foreseeable and how reasonable the owner's efforts were in repairing any dangerous condition on the property or warning visitors about it.

Comparative fault

In some premises liability cases, the property owner may argue that the injured party was partly to blame for what led to his or her injury. As a visitor, you have a duty, in the majority of cases, to exercise reasonable care when it comes to keeping yourself safe.

If the court determines that you failed to exercise care in an appropriate manner, it may limit or reduce your recovery by a percentage equivalent to your fault. For instance, if the court determines that you were 30 percent liable for the accident that caused your injury, and the total damage amount was $20,000, you will receive just $14,000.

Am I just clumsy?

If you have suffered a premises liability-related injury, you may feel that the accident was simply due to your clumsiness. However, this is often not the case. A knowledgeable attorney in Florida can collect evidence from the accident and work hard to pursue a personally favorable outcome for you, considering the circumstances surrounding your case.
