After a crime, is a hotel liable?

You're staying at a hotel when someone breaks into your room. You're robbed and injured in the encounter. The police respond, the offender is arrested and you get your valuables back. However, you also wind up in the hospital, and you're wondering if the hotel is liable.

It certainly can be in some situations, but it depends on a number of factors. Most important, perhaps, is negligence. Did the hotel owners know there was a risk? Did they do nothing to prevent it? If so, then they may have exposed you to a greater level of risk than was necessary.

For example, maybe a past guest stole a room key from the hotel. The owner found out as soon as the guest was gone, and he or she was supposed to change the lock so that it wouldn't accept that key card any longer. However, the owner didn't do it or forgot to do it. You were given the room with the same key card.

Then, the person who had stayed there before returned, used the key card to get into the room, and harmed you. Clearly, this would have been far less likely to happen if the hotel owner had just followed procedure and changed the lock. In failing to do so, through negligence, the hotel owner put you in harm's way and perhaps even misled you by suggesting the key card you had was the only one that worked. Your expectation of safety and privacy was violated.

This same principle could work in other settings, such as an apartment building or a dorm room. No matter the case, if you believe your rights were violated and you were hurt as a result, you may want to look into your options to seek compensation from those responsible.
